On 14 July 1998, the plaintiffs-respondents (hereinafter called the plaintiffs), issued a writ of summons against the Attorney-General, the defendant-appellant (hereinafter called the defendant), in his capacity as the Chief Legal Advisor to the Government of Ghana and the proper party to be sued in respect of all civil cases against the State or the government or a ministry thereof in accordance with article 88 of the 1992 Constitution. On 26 August 1998, the plaintiff applied by summons for summary judgment for the reliefs indorsed on the writ of summons. The application was resisted by the defendant, arguing that it was the plaintiffs, who had caused a delay in the issuance of the guarantee, having rejected two previous ones; and consequently they, the plaintiffs, could not then claim summary judgment for specific performance.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;tab-stops: 90.75pt"><span style="font-size:12.0pt;mso-bidi-font-size:11.0pt;line-height: 115%;font-family:"Book Antiqua",serif">After hearing learned counsel for the parties and reading the various affidavits and the exhibits annexed to them, the High Court (per Akoto-Bamfo J), entered final judgment against the defendant on 8 September 1998, as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;tab-stops: 90.75pt"><span style="font-size:12.0pt;mso-bidi-font-size:11.0pt;line-height: 115%;font-family:"Book Antiqua",serif">"I accordingly enter final judgment for the plaintiffs against the defendants for the reliefs.
