TWUM, J.S.C. <o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On 15th March 1984, Nii Teiko Oworsika III, filed a writ to initiate a chieftaincy suit in the Greater Accra Region House of Chiefs. The petitioner claimed the following reliefs: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(1) A declaration that the petitioner is the Asere Mantse and by the set-up of the Asere Stool, the first respondent cannot be the Asere Mantse. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(2) An injunction restraining the 1st Respondent from putting himself up as the Asere Mantse in the forth-coming Greater Accra Regional House of Chiefs elections and also restraining the Second Respondent from collaborating with the 1st Respondent in achieving the said ends. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Petitioner relied on the FACTS and PARTICULARS to support his claim. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(1) The Petitioner is the legitimate chief of the Asere Division of the Greater Accra Region which consists of not less than seventeen clans or houses. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(2) Amongst the seventeen clans or houses is the Djorshie of which the 1st Respondent is the Chief or Mantse <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(3) For Administrative and Military convenience, the seventeen clans were in the olden times constituted into six subdivisions as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(a) The Dzase, consisting of 4 clans <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(b) The Kpa-Kpatse-We and others <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(c) Chokunna and Jorme-Ser <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(d) Abbetse-We and others <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(e) Tsuro and others <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(f) Djorshie <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(4) All these subdivisions had been under the jurisdiction of the dynasty of Ayi Okun Frimpong Stool. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(5) There are three sub-divisional chiefs in the Asere Division, namely: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(a) The Akwashong Mantse <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(b) The Lante-Djan We Mantse and <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(c) The Djorshie Mantse <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(6) All of these are each in possession of a Black Stool and a Mantse of its own. The left; the Djorshie Mantse was created only in 1919 by Nii Teiko Akotia Oworsika II alias D. P. Hammond, then Asere Mantse. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(7) However, of late the 1st Respondent in complete disregard of these overwhelming historical facts is purporting to describe and perform the functions of the Asere Mantse of which he is not entitled.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(8) Petitioner has information that the 1st Respondent with the active connivance of the 2nd Respondent is making frantic efforts to be elected to the Greater Accra Regional House of Chiefs as the Asere Mantse. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On the 10th April 1984, each of the Respondents filed his statement of Defence and I reproduce them in full below: so that the issues may be clearly appreciated: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1.
