TWUM, J.S.C. <o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On 1st September, 2000, the Appellant issued a Writ of Summons against the Respondent, his former employers, claiming: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"the sum of US $10,000.00 or its Cedi equivalent which the Defendant in February, 2000 under took to pay to the Plaintiff in consideration of Plaintiff waiving all previous accumulated interest thereon." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The writ was followed by a Statement of Claim filed on 4th September, 2000. After the Defendant had entered appearance, the Appellant applied for Summary Judgment on the usual ground that the Defendants had no defence to the action.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant/Respondent resisted the application for Summary Judgment and deposed in its affidavit in opposition that it did not owe the Appellant any such sum or at all. Further, it deposed that it had never promised to pay the Appellant any such sum as alleged or at all. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The learned trial judge dismissed the summons, holding that there were triable issues. The Appellant was dissatisfied with this ruling and appealed to the Court of Appeal on 19th March, 2000. His ground of appeal was that: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The ruling cannot be supported having regard to the evidence before the lower court." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On 29th May, 2003 the Court of appeal dismissed this appeal whereupon the Appellant filed the appeal to this court on 29 May, 2003. His ground of appeal once again was that the judgment was against the weight of evidence. <o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">We have carefully considered the Pleadings and the judgments of both the High Court and the Court of Appeal and it is our opinion that there are indeed triables issues for evidence to be taken. In our view, the issue of the Defendant’s liability cannot be determined summarily once the Defendant/Respondent has denied owing the Appellant. There is no documentary evidence of admission of liability. In the circumstances we hold that the appeal is unmeritorious and the same is hereby dismissed.<o:p></o:p></span></p></span>
