Opanyin Kwabena Adu died on 13th February, 2003 and his Will was admitted to Probate. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Plaintiff/Appellant herein referred to as the Appellant commenced the action by issuing out an originating summons under Order 54 rule 4 of the repealed High Court [Civil Procedure] Rules of 1954 [L.N. 140A] now C.I.47 on the 3rd of April 2003 requesting the High Court to interpret and determine the true meaning of paragraph 2[d] of the said Will of the late Opanyin Kwabena Adu. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The suit was tried and judgment was given against the appellant and the Appellant being dissatisfied with the judgment has appealed against the judgment of the High Court Kumasi. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Paragraph 2[d] of the Will of the Opanyin Kwabena Adu dated 25/8/1999 is as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"To my house No. 44 Blk 3 Old Tafo, Kumasi. My own store room and three rooms up-stairs are devised to Afua Adade and her children." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">After the death of Opanyin Kwabena Adu the two Executors who are the Respondents in this suit obtained Probate from the High Court on 10th September, 2003 to administer the estate of the testator. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Respondent distributed the estate to the beneficiaries including the appellant. The essence of making a Will is to declare the intention of the testator as to how his or her property or properties should be distributed to the beneficiaries after his or her death. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Paragraph 2[d] of the Will of the late Kwabena Adu is as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"2[d] My own store-room and three rooms up-stairs are devised to Afua Adade and her children" <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">According to the Respondents who were the Executors of the Will of Opanyin Kwabena Adu when they obtained the Probate at the High Court, they gave AFUA ADADE and her children the store-room of the testator and three rooms up-stairs. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In paragraph 2[d] the Testator devised his store-room and three rooms upstairs to the appellant and her children. The Testator described the rooms as rooms up-stairs to locate where the rooms and the store are or were. <o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In our candid opinion there is no ambiguity whatsoever in paragraph 2[d] of the Will of Opanyin Adu and the Executors [Respondents] were right in giving the store room and three rooms up-stairs of the House No. 44 Blk.33 Old Tafo Kumasi to the appellant. The appeal is accordingly dismissed.<o:p></o:p></span></p></span>
