J.</span></b><span style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua","serif"">A <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">This appeal is taken from the judgment of the High Court Accra dated the 24th February 2004. By a writ of summons, the Plaintiff/Appellant hereinafter called the Plaintiff claimed the following:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(1) Recovery of the sum of ¢233,200,000.00 being outstanding balance of financial assistance granted to the Defendant and <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(2) Interest on the said sum from April 2002 till the date of final payment at the prevailing interest rate. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant/Respondent hereinafter called Defendant by her statement of defence also counterclaimed as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(1) An order compelling the Plaintiff to refund to Defendant the sum of ¢291,000,000.00, which the Defendant overpaid to her. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(2) Interest on the said amount from 10th July 2001 to date of full and final payment. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(3) General damages for breach of contract to lend Defendant ¢475,000,000 to make a total of ¢1 billion. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">At the end of the trial, the Court found for the Plaintiff and entered judgment against the Defendant for the sum of ¢111,000,000.00 being outstanding balance of financial assistance granted to the Defendant together with interest from 31- 4 - 2002 till date of final payment at the prevailing interest rate. Cost in the suit was assessed at ¢10 million for the Plaintiff. It is against the award of ¢111,000,000 by the trial Court instead of the amount of ¢233,200,000.00 endorsed by the Plaintiff on his writ, that this appeal was mounted. I observed from the record of this appeal that on the 15 - 11 - 2005, the Defendant was granted leave by this Court to apply for the variation of the judgment of the trial Court. Accordingly the Defendant filed her notice contending that the judgment be varied on the 21 - 11 - 2005. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">By his notice of appeal filed on the 24 -3 - 04, the Plaintiff complained that the relief sought per the writ of summons was not wholly granted. The ground of the Plaintiff appeal was stated as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The judgment failed to appreciate the contract between the parties which was exhibited and consequently awarded reliefs far short of actual amount owed by the Defendant to the Plaintiff." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Plaintiff by this appeal sought a relief that the judgment be corrected so that Defendant pays the actual amount owed to the Plaintiff as endorsed on the writ of summons. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant on the other hand by her notice seeking an order of variation of the judgment prayed as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(1) That the judgment dated 24/2/2004 be set aside and or reversed. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(2) That judgment be entered for the Defendant on her counterclaim. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant formulated and argued three grounds to supp
