This is an appeal from the judgment of the High Court, Kumasi dated 13th October, 2003, presided over by his lordship J.K. Abraham.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> The appellant [hereinafter referred to as the Defendant] is a limited liability company operating at Bogoso but having a branch at Obuasi. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Respondent [hereinafter referred to as the Plaintiff] was until his dismissal the site superintendent of the Defendant company's branch at Obuasi. The facts of this case are that during the tenure of office of the plaintiff, the Defendant company received a series of reports involving stealing, fraudulent deals and conflict of interest connecting some members of its staff at the Obuasi branch in contravention of the Company's policy. The plaintiff/Respondent in his position as the site superintendent knew of all those occurrences at the Branch. The Defendant/Appellant commissioned a private investigator to investigate all illegal and unlawful occurrences at its Obuasi branch and the Plaintiff/Respondent was implicated in most of the acts. As a result of this, he was interdicted by the Defendant/Appellant. Subsequently a committee of inquiry was set up by the Defendant/Appellant company to inquire into the allegations levelled against the Plaintiff/Respondent. At the end of the hearings, the Respondent was found guilty of four of the five charges levelled against him and in accordance with the Appellant's rules and policies, he was accordingly dismissed. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Respondent brought an action against the Appellant at the High Court stating among other things that his dismissal was in preach[sic] of the terms of his employment and that he was denied his rights of natural justice at the inquiry set up by the Appellant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> The trial High Court in its judgment delivered on 13th October 2003 upheld the Respondent's claim and granted all the reliefs endorsed on his writ of summons, save the order for reinstatement to his former position in the Appellant's company. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is against this judgment that the Appellant has appealed. The Appellant filed two grounds of appeal; namely:—<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> [a] The judgment complained of is against the weight of evidence and the Learned Judge failed to give adequate consideration to the evidence adduced by the Defendant/Appellants/Applicants.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> [b] The Learned trial judge erred in granting the Reliefs sought by the Plaintiff/Respondent. The <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Respondent's writ of summons was for the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> [1] a declaration that the Plaintiff’s dismissal in the Defendant Company was wrongful. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[2] An order directing the Defendant to pay to the plaintiff all salaries, entitlements and other emoluments unearned by the Plaintiff as a result of the unlawful dismissal from the date of dismissal to the date of final judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[3] General and special damages for wrongful dismissal.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> [4] An order for the reinstatement of the Plaintiff to his former position. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Respondent in his evidence-in-chief before the trial court sought to establish that his dismissal by the Appellant Company is in breach of his terms of employment and that he was denied his rights of natural justice at the inquiry set up[sic] the Appellant Company.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Boo
