The court below dismissed an application seeking an order for the attachment of the respondents herein, who were also respondents in the court below, for contempt. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Aggrieved by and dissatisfied with the said ruling, the appellants, who went to the court below as applicants, have launched this appeal on grounds as set out below. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The appellants' original ground of appeal states:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The entire ruling is manifestly against the weight of the evidence adduced at the trial." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The first additional ground of appeal reads:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The learned trial judge erred in law in holding that an action in chieftaincy as was determined by the Judicial Committee of the Central Region House of Chiefs in the suit entitled Ebusuapanyin Kojo Abor and others versus Nana Abor Ewusie XIX is a personal action that abated upon the death of the appellant, Nana Abor Ewusie XIX". <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The second additional ground of appeal also reads as follows:—<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The learned trial judge was wrong in giving judgment for the respondents on the basis that the sole purported appellant in the suit before the Judicial Committee of the Central Region House of Chiefs had died before the said judgment was delivered when in actual fact there were two appellants, namely Nana Abor Ewusei XIX and Ebusuapanin Kweku Wu." <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The facts at the background of the case are slightly complicated and require some patience to sort out. The respondents herein were victorious in the action they instituted before the Judicial Committee of the Gomoa Assin Traditional Council [GATC].
