By the High Court judgment referred to supra, the Court allowed an appeal against the decision of the ersthwhile Community Tribunal, Sefwi-Wiawso dated 13th May, 2002. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">By its decision, the Community Tribunal, Sefwi-Wiawso delivered judgment in favour of the Defendants/Respondents/Appellants hereinafter referred to as the Appellants. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">At the Community Tribunal, Sefwi-Wiawso the Plaintiff/Appellant/Respondents, hereinafter referred to as the Respondents originally claimed as against the Appellants herein, the following reliefs:— <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">"Declaration that all that Three Houses situate at <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(1) Karo and (ii) Akurase all in Dwenase (which were part of the inventory in the application for letters of administration in respect of the Estate of late Kwadwo Bih) are the Plaintiffs' family properties and should be deleted from the inventory. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(2) Single Barreled gun in the Defendants' custody is the Plaintiffs family property". <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Appellants herein, also filed a counterclaim in the following terms:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">"(a) A declaration that the properties stated in the writ of summons are the self acquired properties of the late Kwadwo Bih. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(b) An order for the distribution of the estate of the late Kwadwo Bih in accordance with PNDC Law 111". <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">At the end of the trial, the Community Tribunal delivered judgment in favour of the Appellants as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">"the Plaintiffs having failed to prove their case to the satisfaction of the court, the irresistible conclusion is that their claims fail and same ought to be dismissed with ¢1 million costs. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">"On the other hand, we are satisfied that the properties in contention are self acquired properties of the late J.K. Bih. The counterclaim is sustained as we think it has been proved to our satisfaction". <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Having so held, the trial Community Tribunal then proceeded to distribute the property of the Deceased J.K. Bih in accordance with Intestate Succession Law, PNDC Law 111. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Respondents, herein, therein Plaintiffs, felt aggrieved by the said decision and successfully appealed against it to the High Court, Sefwi-Wiawso which allowed the appeal and instead gave judgment in favour of the Respondents on 7th April, 2004. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Accordingly, the High Court, Sefwi-Wiawso delivered itself thus, <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size
