Even though, as reflected in the pleading, the issues that were set down for hearing did not include one relating to the capacity of the plaintiff/respondent to bring an action, on the 9th of September, 2003 the defendants/appellants brought a motion for an order dismissing the suit for want of capacity, or in the alternative for an order staying proceedings in the case. The circuit court dismissed the motion as “unmeritorious and abuse of the court process.” The defendants appealed to this court and their sole ground of appeal was that the ruling cannot be supported in the face of the documentary evidence.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"> I think the documentary evidence referred to by the defendants/appellants consists of the judgment of the High Court, Cape Coast in the case of <i>Samuel Jones (Substituted for Opnyin Yaw Tawiah) & Another v. Kwesi Bo</i> which may be found at pages 65-69 of the record of appeal in which it was declared that the defendant in that case, who is the plaintiff/respondent in this appeal, was not the overall head of the Royal Adwenadze family of Edukrom, which was confirmed by this court as exhibited at pages 70-77 of the record of appeal. Currently, there is an appeal to the Supreme Court against the decision of the Court of Appeal, which is pending. In his ruling
