According to her this particular transaction is one of several offered to the defendant who is also a member of the association.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The other defendants mentioned in the Writ are guarantors of the defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The amount of three hundred million cedis is part of money sourced by the plaintiff from the Ghana Commercial Bank (GCB) to the knowledge of the defendant, which is given to members of the Association known as Ahenfie Cloth Sellers Association to develop their financial capacity in the textile trading business. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The 1st defendant in her defence does not deny that she took money from the plaintiff but said that what she took is two hundred and fifty-five million cedis, and not three hundred million cedis that she requested to. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is her contention that plaintiff took forty-five million cedis as upfront payment for the 300 million cedis approved and was paid two hundred and fifty-five million cedis. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">More importantly, the defendant contends that the financial relation is one of a money lender and a borrower transaction which is illegal and unenforceable in terms of the money lenders ordinance, Cap 196 which describes money lender in section 2 to include every person whose business is that of money lending or who carries on or and verifies or announces himself or holds himself out in any way as carrying on this business, whether or not he also possesses or owns property or money derived from sources other than the landing of money and whether or not he carries on the business as a principal or an agent; but shall not include; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(a) Any security registered under the co-operative societies ordinance; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(b) Anybody corporate, incorporated or empowered by special ordinance to lend money in accordance with such ordinance <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(c) Any person bonafide carrying on the business of banking or insurance or bonafide carrying on business, not having for its privacy object the lending of money, in the course of which and for the purposes whereof he lends money; or <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(d) From any person or body corporate exempted from the provisions of this ordinance by order or council, or <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(e) Any pawn broken licensed under the pawnbrokers ordinance, where the loan is made in accordance with the provision of the pawnbrokers ordinance and does not exceed fifty pounds. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Section 3 of the same Ordinance
