The appellant put up buildings thereon and carried its business therein. In 1993 pursuant to the request of the respondent for a lease of a portion of the land on which to construct stores for its business the parties executed exhibit B. I set it out in full as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"THIS INDENTURE made the 18th day of November in the year of our lord one thousand nine hundred and ninety-three (1993) BETWEEN P Y ATTA & SONS LIMITED, a company incorporated under the laws of Ghana and having its registered office at B 37/1, Graphic Road, South Industrial Area, Accra (hereinafter called the 'Sublessor' which expression shall where the context so requires or admits includes its successors and assigns) of the one part and KINGSMAN ENTERPRISE LIMITED acting through its Managing Director, KINGSLEY AGYEMAN of Post Office Box 1538, Dansoman, Accra (hereinafter called the 'Sublessee' which expression shall where the context so requires or admits includes its successors and assigns) of the other part. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">WHEREAS by a lease (hereinafter called 'the lease') dated the 11th day of May 1972 and made BETWEEN the Government of Ghana (hereinafter called 'the lessor') of the one part and the sublessor herein therein described as the lessee of the other part and registered as No 1067/1972 the property herein was demised by the lessor to the sublessor for a term of 50 years from the 11th day of May 1972, subject to the payment of the rent therein reserved and to the covenants agreements and conditions therein contained. The Sublessor has agreed with the sublessee in consideration of the covenants on his part hereinafter contained for the lease of part of the land comprised in the lease for the residue of the term thereby granted subject to the rent thereby reserved and to the covenants agreements and conditions therein contained. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The sublessor as the beneficial owner HEREBY grants unto the sublessee part of the land comprised in and demised by the lease TO HOLD UNTO the sublessee for all the residue now unexpired of the said term of 50 years granted by the lease subject henceforth to the payment of the rent and the covenants agreements and conditions herein contained and to be observed and performed by the sublessee. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The sublessee HEREBY covenants with the sublessor as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> (a) Within twelve months from the date hereof to build and complete a store consisting of six-room together with toilets in a good and workmanlike manner with all necessary walls fences sewers and drains in accordance with the plans sections and elevations already approved by the Accra Municipal Authority and to the satisfaction of the sublessor; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(b) To give two stores, and toilet to the sublessor after completion; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(c) To obtain from the authorities all necessary permission approved of plans and specifications and other things required by law for such building and to pay all fees and expenses payable in respect thereof; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(d) To pay rent of forty thousand cedis (¢40,000) a month from two years after the stores have been completed and the sublessee had gone in. The rent shall thereafter be reviewed every five (5) years; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(e) To pay and discharge all rates, taxes easements impositions duties, charges and outgoings whatsoever which may hereafter become imposed or charged upon the demised premises or payable by the occupier in respect of the four (4) stores; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(f) At all times during the said term to keep the interior of the stores, windows, doors, pipes and drains in good and substantial repair and condition; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(g) Not to assign or underlet any part of the stores without prior consent of the sublessor in writing but such consent not be unreasonably withheld; <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;f
