He also averred that he was entitled to end of service benefit when he resigned from the second defendant company at the rate of 6 months basic salary per each year of service at #[sic]150,000.00 and ¢138,937,500.00. Despite persistent demands the 2nd defendant refused to pay him. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The first defendant denied substantially the claims by the plaintiff and more particularly that the plaintiff rendered any services or carried assignments to him or the Company; neither did they agree orally or in writing to pay any compensation of ¢190,000,000,00 or at all to the plaintiff and demanded a proof. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The second defendant averred that until 1986, the plaintiff was the Acting General Manager of the second defendant company. He was never appointed its Managing Director and only masqueraded as such in the absence of one Mr. Barbar Beany. On 30-31 January 1989, the plaintiff was made a director of the company. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The second defendant went on to deny the plaintiff was entitled to be paid any end of service benefits for all who were entitled thereto were paid in 1992 upon a government directive under the plaintiff's supervision. The plaintiff would have paid himself if he were entitled to any such payment. At any rate the plaintiff forfeited any payment when he looted and raped company funds. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The defendants counterclaimed for the return of monies the plaintiff stole, the use of the Managing Director's car number ARD 8282 from 27-7-94 to 4-4-95 at ¢50,000.00 per diem and the use of the Managing Director's duty post bungalow at ¢20,000.00 per month from 27/7-27/7/94 to the date of evacuation. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The issues settled for trial at the summons for direction were: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">a) Whether or not the plaintiff was a Managing Director of the 2nd Defendant Company. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b) Whether or not the Plaintiff is entitled to End of Service Benefits after his resignation from the 2nd defendant company. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">c) Whether or not plaintiff served the 2nd defendant loyally. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">d) Whether or not Plaintiff is entitled to any or all of his claims<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> d) Any other issue raised by the pleadings. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">At the trial the parties led oral and documentary evidence and called a witness to testify in support of their respective cases, at the end of which the trial judge allowed the plaintiff's claim for end of service benefits at the rate stated above, amounting to ¢102,960,000,000.00 with interest thereon at the rate prevailing in Ghana to run from 1st November 1994, to the date of judgment. The trial judge also upheld the plaintiff’s claim for an offshore salary of #[sic]144,000.00 with interest at the rate prevailing in England, plus ¢5 million costs. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The second defendant appealed to the Court of Appeal against the judgment of the High Court and lost, for that court affirmed the judgment of the trial court
