On the 9th day of November, 2004 the Plaintiff/Respondent, hereafter referred to as the Plaintiff issued a writ of summons and statement of claim against the Defendant/Appellant hereafter referred to as the Defendant claiming the following reliefs:—<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> (i) Recovery of the sum of US $70,000 being monies advanced to the Defendant for the supply of second hand clothes to plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> (ii) Interest on the said amount from July, 2004 till date of final judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif">(iii) Costs<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> 2. Defendant after service on him of the writ of summons and statement of claim caused an appearance to be entered on his behalf by his Solicitor. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif">3. On the 6th day of May, 2005, the Fast Track High Court, Accra granted a summary judgment against the Defendant, even though there was an affidavit in opposition which raised certain pertinent issues.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> 4. On 2nd September, 2005, the Defendant filed a motion to set aside the summary judgment granted on 6th May, 2005, on the basis that hearing notice of the hearing of the summary judgment was neither served on the Defendant nor his counsel. It must be noted at this stage that the Defendant is ordinarily resident outside Ghana, hence the address for service on the writ of summons indicates that fact. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif">5. On the 3rd February, 2006, a Ruling was delivered by the High Court, Fast Track Division, Accra dismissing the application to set aside the summary judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif">6. On the 2nd May, 2006, the Defendant filed an appeal against the said summary judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif">7. Thereafter a number of interlocutory applications were filed by the Counsel for the Defendant which were all either struck out for want of prosecution or dismissed. As a matter of fact, the conduct of learned Counsel in turning up late for most of these Applications in court is to say the least very disappointing and conduct unbecoming of senior counsel.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> 8. On the 25th day of January, 2007 the Defendant filed a Stay of Execution of the Summary Judgment of 6th May, 2005 after previous applications for Relistment and Stay of Execution were struck out. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">This Application for Stay of Execution was dismissed by the High Court on 6th February 2007, whereupon the Defendant filed the instant repeat application for Stay of Execution of the Summary Judgment on 16th February, 2007 before this Court. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Learned Counsel for the Defendant, Boakye Agyen argued forcefully that there are serious arguable issues to be raised on appeal. These include the fact that there is proof that there was no hearing notice served on the Defendant or his counsel before the Application for summary judgment was heard. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Seco
