His case is that his uncle had at a meeting before his death in the presence of witnesses bequeathed his properties inclusive of the two houses to him. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Defendant's case is that the house No. C. 153/13, Mamobi had been gifted to her mother who was the wife of the plaintiff's uncle during his life time. That Moshie died possessed of only house No. J. 382/7 among other personal properties.
