Recovery of the sum of US$131,705.46 payable in cedis at the Forex Bureau rate being arrears of rent due and payable up to February 2006 in respect of property No.57, Examination Loop, North Ridge Residential Area, Accra. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b. Termination of the Agreement dated the 17th August. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">c. Recovery of possession of property No.57, Examination Loop, North Ridge Residential Area. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">d. Prevailing Bank Interest on amount due". <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The claim relates to property leased to the defendant by the plaintiff for a term of 15 years at a monthly rent of $6,000. Plaintiff pleads the mode of payment of the rent in paragraph 4 of the statement of claim:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"The plaintiff avers that the defendant by the term of the lease Agreement was expected to pay 50% of the rent by the plaintiff for the first five years and thereafter 60% of the rent for sixth to the tenth year of the sublease and finally 70% or a rent tenth to the end of the lease". <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">According to plaintiff the defendant has defaulted in the payment of the rent. Even though the 1st plaintiff Evelyn Aku Ankrah testified, it was Mr. Carl Engman of James Quagrine & Co. who plaintiff called to establish their case. At the end of his evidence, particularly his cross-examination it showed that the defendant owed the plaintiff $96,125.42 including interest and $10,907 being unpaid rent for 2005. He was asked:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"Q: So as at the date of the issue of the writ which was 6th June, 2006 the amount owned was $96,125.42 being payment debt plus interest and $10,907 being 2005 unpaid rent is that correct? <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A: Yes". <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Before this it is Mr. Engman's evidence that the year 2006 rent has been fully paid for. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Plaintiff counsel, Mr. Anancy asked his witness:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">"Q: Mr. Engman, the last few questions asked by counsel he mentioned two figures. The question was what was the balance due and you mentioned $96,125.42 and another figure $10,907 what do these two figures represent? <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A: The first figure that is $96,125.42 represents the judgment debt plus 2% interest up to January, 2007". <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">From these answers I will have to accept the evidence which concluded the matter that the debt is indebted to the plaintiff in the sum of $96,125.42 plus $10,907.<o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">I will award cost of Eighty Million Cedis (¢80,000,000) in favour of the plaintiffs.<o:p></o:p></span></p></span></span></span>
