Recovery of possession of the rooms being occupied by the Defendant in H/No 21 Block 9 Asokwa New Amakom Extension Kumasi. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">b. Damages for trespass <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">c. An order for perpetual injunction restraining the Defendant, his servants, agents and any person or persons claiming title through him from interfering with the Plaintiff's property in dispute as the Defendant has not got any defence to the Plaintiff's action upon the grounds set forth in the accompanying Affidavit. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Plaintiff/Applicant's Writ of Summons and Statement of Claim were duly served on the Defendant/Respondent on 8th day of December 2006. Upon receipt of the Plaintiff/Applicant's Writ of Summons and Statement of Claim the Defendant/Respondent caused his solicitors Messrs Anaglate and Co to enter appearance on his behalf which appearance was duly entered on 19th day of December 2006. Thereafter the Defendant/Respondent failed or neglected to file his Statement of Defence to the action. It must be pointed out that at the time for the hearing of this motion for judgment, the Defendant/Respondent has not filed any Statement of Defence to this action. When the Plaintiff/Applicant's Motion On Notice For Judgment was also served on him, the Defendant/Respondent failed to file any affidavit in opposition. <o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The contention of Counsel for the Plaintiff/Applicant is that the Defendant/Respondent's grantor was permitted to occupy the premises for three years and that the grantor also permitted the Defendant/Respondent three years to occupy same. According to Counsel for the Plaintiff/Applicant the three years has long elapsed and that the Defendant/Respondent has no defence to this action. He therefore prays this court to enter judgment in favour of the Plaintiff/applicant against the Defendant/Respondent. I have carefully read the Plaintiff/Applicant's Writ of Summons and Statement of Claim together with his Motion on Notice for judgment and the affidavit in support. I have come to the conclusion that this application is properly before this Court. In actual fact the Defendant/Respondent has not shown any cause by an affidavit in opposition or otherwise why judgment should not be entered against him. I am satisfied that the Defendant/Respondent has no defence to this action. I therefore enter final judgment in favour of the Plaintiff/Applicant against the Defendant/Respondent and order the Defendant/Respondent to yield his occupation of the rooms he occupies in House No. 21 Block 9 Asokwa New Amakom Extension Kumasi to the Plaintiff/Applicant forthwith. The Defendant/Respondent his servants, agents and any person or persons claiming title through him are perpetually restrained from interfering with the Plaintiff/Applicants property in dispute. The Defendant/Respondent will pay costs of ¢5,000,000.00 to the Plaintiff/Applicant.<o:p></o:p></span></p></span>
