LTD <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">This case originated in the High Court Accra as Suit No. Misc. 768/97 in which the plaintiff sought and obtained reliefs in which the court made an allocation of shares, appointed directors for the third defendant company as well as signatories to its account. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">These orders were quashed by this court for lack of jurisdiction, see IN RE SPEEDLINE STEVEDORING CO. LTD. REPUBLIC VS. HIGH COURT, ACCRA EXPARTE BRENYA (2001-2002) SCGLR 775. Subsequently to this decision the registrar of the court of Appeal, where an appeal had earlier been made in the same case upon the interested party's application and order of transfer by the Chief Justice withdrew the docket thereof and put it before the Fast Track Court presided over by Gyaesayor J. The applicants took the objection to the proposed retrial of the case on the ground that this court's decision reported in (2001-2002) SCGLR 775 had disposed of all the company law issues as earlier set up supra and therefore could not be retried. In overruling the objection Gyaesayor J held that the "application did not determine the rights of the parties in respect of the claim as endorsed .... " <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is trite law that a court order or judgment subsists unless varied or set aside by a court of competent jurisdiction. This can be done in several ways including appeal and resort to the supervisory jurisdiction is one of such ways. The effect of an order made in the supervisory jurisdiction depends on its nature. If for example the whole trial is quashed the court below may retry the case all over again if it has jurisdiction over the subject-matter. In this case it was only the specific orders made on 12 May 2000 and 19th January 2001 respectively that were quashed by this court as being made without jurisdiction. It was not the whole judgment that was quashed, therefore there can be no warrant for retrial of the whole case (which comprised two consolidated actions). <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It was contended by Counsel for the respondent that the said certiorari decision of this court dated the 8th May 2001 (the reasons for which were delivered on 16th June 2001) was a nullity for want of jurisdiction sin
