The appellants are the traders themselves. The Madina Shopping Mall Association is only in the position of an ATTORNEY, and could not therefore have been permitted to prosecute the plaintiff/appellants’ action at the Court below, without a POWER OF ATTORNEY. I will come back to this issue in due course. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The appellants filed numerous grounds of appeal, viz: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[a] That the evidence is against the weight of the evidence on record. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[b] That the learned trial judge erred by making wrong findings of fact and thereby arrived at wrong conclusions resulting in gross miscarriage of justice to the Plaintiff/Appellant. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[c] That the learned trial judge failed to adequately appreciate the issues for trial and thereby ignored same in determining the matter properly. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[d] That the learned trial judge failed to appreciate the issue of fraud which was fundamental in the proper resolution of the matter. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[e] The learned trial judge erred by descending into the arena of conflict by substituting his own case for that of the Defendants/Respondents. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[f] That the trial judge erred by preferring the case of the Defendants/Respondents to the Plaintiff/Appellant even though their evidence in court was contrary to their pleadings. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[g] The trial judge erred by construing the attempted negotiations for settlement by the parties prior to the commencement of the suit as binding on the Plaintiff/Appellant. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[h] The trial judge erred by concluding that the transaction between the plaintiff/Appellant and the Defendants/Respondents was one of a leasehold whilst at the same time holding that the parties were not ad idem to the nature and terms of the transaction. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[i] That the trial judge erred by regarding the over ¢3.6 bn paid by Plaintiff/Appellant as money paid only to secure their Shops/Stores, which is unknown in law. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The facts which gave rise to this litigation are simple. The 2nd Defendant/Respondent, E. M. Frimpong, who was the Managing Director of the Rosehill Shopping {Gh] Ltd., acquired a piece of land at Madina, and commenced construction of stores on that land. Some traders, who claimed to be members of the Madina Shopping Mall Association, expressed interest in the stores being constructed, and applied for allocation of such s
