The Amended Grounds of Appeal pursuant to leave granted on the 23-5-07 are as follows:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1. The judgment is against the weight of evidence. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">2. The trial Circuit Court, Kumasi, had no jurisdiction on account of the value of the disputed house at the time it purported to trial the case. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The relief being sought from this court is that the judgment of the Circuit, Kumasi, be set aside. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The back ground to this case is as follows; <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiffs claim against the defendants, jointly and severally the following reliefs <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[a] Ejectment and recovery of possession of the rooms the defendants are occupying at House No. PLT 11, BLOCK X, New Amakom, Kumasi, since plaintiffs urgently need same for their own use and for the use of members of their family. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">[b] Mense profits. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In their 8 paragraph statement of claim, the plaintiffs aver among other things that, they are the owners of the House mentioned supra, by virtue of purchase as evidence by a Deed of Assignment dated 26-7-99, made between William Frank Idun and Mr. and Mrs. Akoto, the plaintiffs herein. Plaintiffs continue that, the assignment was registered at the Lands Registry, Kumasi on the 15-10-99 under title No. 17514 with serial No. 612/99. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is the case of the plaintiffs’ that, the defendants who live in the said house are aware of the said sale. That plaintiffs purchased the house for their personal occupation and also for the occupation of members of their family. Plaintiffs continue that, on the 7-10-99, on their instruction, defendants were given notice to vacate the said premises by 31-1-2000. The defendants, through their solicitor informed plaintiffs that the said house is their family property and therefore would not move from the premises. Plaintiffs concluded that, the defendants’ adverse claim to the said house is false and only calculated to frustrate the plaintiffs in their bid to live in their own house hence this action.
