No further or additional grounds of appeal were, however filed. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The brief facts are that the appellants filed in the court below a motion for judicial review brought under Order 55 rules 1 & 4 of the High Court Civil Procedure Rules, 2004 (C.I. 47) and Articles 23 & 33 of the 1992 Constitution of the Republic of Ghana praying for an order in the nature of certiorari to quash the decision of the Vice-Chancellor of the Kwame Nkrumah University of Science and Technology by which he authorized the dismissal of the appellants from the University. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On 20th November 2006, the trial court, in its ruling, dismissed the application. It is this ruling of the court below, which is the subject of this appeal. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">After having been served with the Notice of Appeal, the respondent also filed a notice under rule 15 of the rules of this Court (i.e. C.I. 19) on 19/1/07 praying for a variation of the judgment of the court below. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In his statement of case filed on 8/6/07, the appellants who were the applicants in the Court below argued grounds (1) and (3) of the notice of appeal together. He followed that up with the second and last ground. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The appellants’ case was that they were not invited to appear before any committee of enquiry to investigate the offences they were alleged to have committed. Again no offences were ever preferred against them before their dismissal. They referred to a document titled ‘Students Guide’, which, according to them, regulates the relationship between the students and the University. They contended that this document prescribes the way and manner the University should handle cases involving students.
