The application was dismissed by the Court below. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">Aggrieved by the ruling, he on 22/10/07 filed Notice of Appeal against same. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">The action in the Court below is a probate action in which the plaintiff, Executors/Executrix of the WILL of one Kwasi Adjei of Ayeduase is seeking the following reliefs: <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> <i>[a] "a declaration that the WILL of Kwasi Adjei dated 21st July, 1988 is valid"<o:p></o:p></i></span></p><p class="MsoNormal" style="margin-left:.25in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">[b] "an order that the said will be admitted to probate." <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">The Defendant, a son of the said Kwasi Adjei is disputing the validity of the WILL on the ground that his deceased father did not and could not have made the purported Will and that the same is a forgery and not his father's Deed.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> He has therefore counter-claimed for:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> <i>"A declaration that the purported WILL is invalid."<o:p></o:p></i></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> The writ was issued on 12/11/99 and the statement of claimed filed on 16/12/99. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">The Applicant herein is also a son of the deceased and uterine brother of the Defendant. He is ordinarily resident in the United Kingdom and therefore sought to be joined in the suit per an Attorney. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">Moving the application, counsel referred to the appeal filed and urged upon this Court that the appeal has an excellent prospect of success and in this regard cited authorities to support his submission that the ruling of the court below refusing the application for joinder was in error.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> In this application, what I think the court has to concern itself is whether there is the real need to stay proceedings going on in a court of competent Jurisdiction when the Court itself found no such need when a similar application was taken before it. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">With due deference to counsel, the authorities cited do not touch on application for stay of proceedings. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">In the affidavit in support of the application, the applicant averred that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif""> "It is eminently proper and just that the proceedings be stayed so as to avert the situation where a Monumental miscarriage of justice will be occasioned the applicant whose successful appeal will no doubt be stultified and rendered otiose."<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif""> The Applicant further averred that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif""> "in those circumstances the Honourable Court would have embarked on an exercise in futurity and the parties put to irreparab
