line-height:107%;font-family:"Book Antiqua","serif"">Probate of the Will of the late William Anthony Duana Kwofie @ Kofi Anthony dated 14th February 1961, was obtained at the Cape Coast High Court on 27th August 1963, the deceased having died on 27th May 1963. The testator, by Clause 3 of the said Will, stated inter alia <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">“I give and bequeath my house number G. 97/2A of Governor Rowe Road, Cape Coast…………as follows: <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">Half of the main building Northward to my niece Mrs. Araba Bentsiwah-Boison alias Araba Bentsiwa; together with two boys rooms East of and close to my late brother Henry O. Duana Kuofie’s main building. At her death her portion should automatically go to her daughter and from her daughter to her daughter”. Exhibit ‘5’. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">The late Kofi Bentsi-Enchil who died on the 28th day of January 1948, executed a Will on 13th June 1946. Probate of the Will was granted on 20th April 1948. Clause 2 of the said Will partly states:— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">3. “I bequeath to my dear Alice (Kuofie) alias Esi Konama my house at Cape coast situate at No. 10 Jackson Street with a strong injunction that it shall pass to her eldest surviving child on her death”. Exhibit ‘C’ and Exhibit ‘4’. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">Clause 16 of the said Will also states in part— <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">“16”…I therefore most-solemnly bequeath the whole of my estate known as Adaaso together with all messuayes, plants, buildings, form houses erected thereon including “Aliswell’ House, Cook’s House, poultry livestock and garage to my children Araba, Kodwo and Kwesi-Kobea Bentsi-Enchill……” Exhibit ‘4’ and Exhibit ‘C’. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua","serif"">Mrs. Araba Bentsiwa-Boison referred to in the Will of the late William Antnony Duana Kuofie in Exhibit ‘C’ & ‘4’, is the same person referred to in Clause 2 of Exhibits ‘C’ and ‘4’ as <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><i><span style="font-size:12.0pt;line-height: 107%;font-family:"Book Antiqua","serif"">“her el
