The defendant averred further that, plaintiff and his family members also owned a piece of land which they farm with the authority and consent from the present occupant of the stool, Oheneba Barimah Adu Asabre Poku and the land shares common boundaries with the Defendant’s Royal Stool land. He maintained that it is rather the plaintiff who had trespassed onto the defendant’s portion of Agogoho land and made adverse claim to same. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""> At the close of pleadings, the issues set down for the trial of this suit were as follows: <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[1]] Whether or not the disputed land the subject matter of this suit before this Court is known as “Nkwantanan” or “Agogo”. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[2] Whether or not the disputed land was cultivated in its virgin state by the plaintiff’s maternal grandfather Yaw Frimpong . <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[3] Whether or not the proprietary interest in the disputed land is vested in the stool belonging to the defendant’s royal family.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[4] Whether or not the defendant has trespassed unto the disputed land. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[5] Whether or not the defendant’s royal family at Bogyawe is the legitimate owners of the disputed land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[6] Whether or not the plaintiff is entitled to his claim. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">[7] Any other issues raised on the pleadings. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""> The case went through a full trial with the parties testifying and calling witnesses. At the end of the trial judgment was entered in favor of the plaintiff against defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""> Dissatisfied with the said judgment, the defendant has appealed to this Court.
