The plaintiff/appellants to be referred to as appellants, by their writ of summons claimed the following reliefs:- <b><o:p></o:p></b></span></p><ol style="margin-top:0in" start="1" type="1"> <li class="MsoNormal" style="text-align:justify;mso-list:l3 level1 lfo1"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A declaration that the devise made in paragraph 4 of the last Will of Emmanuel Kwesi Agyei Debrah which affects House No.SDA 143 is void and of no effect. <o:p></o:p></span></li> <li class="MsoNormal" style="text-align:justify;mso-list:l3 level1 lfo1"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A declaration that the devise made by Emmanuel Kwesi Agyei Debrah at paragraph 6 of his last Will which affects House No. SD/A 140 is illegal, void and of no effect.<o:p></o:p></span></li> <li class="MsoNormal" style="text-align:justify;mso-list:l3 level1 lfo1"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A declaration that the devise made by Emmanuel Kwesi Agyei Debrah at paragraph 3 of his last Will which affects House No. SD/F 16 Koforidua is illegal void and of no effect.<o:p></o:p></span></li> <li class="MsoNormal" style="text-align:justify;mso-list:l3 level1 lfo1"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">A declaration that the devise made by Emmanuel Kwesi Agyei Debrah at paragraph 9(ii) of his last Will which affects the farm land at Beposo Pole Ase Obuotabiri is illegal, void and of no effect.<o:p></o:p></span></li> <li class="MsoNormal" style="text-align:justify;mso-list:l3 level1 lfo1"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Perpetual injunction to restrain the dependants, the beneficiaries under the said devise under the said Will, the agents children and all parties who claim any interest in the said proportion through them.<o:p></o:p></span></li> </ol><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The appellants are the grand children of the late Mr and Mrs Moses Debrah Snr. Moses Debrah Snr. and Sophia Debrah were married under the Marriage Ordinance Cap 127 of 1884. Consequently upon his death his self acquired estate was distributed according to that law. His survived spouse Sophia Debrah was given 1/3 of the estate, their eight (8) children had 1/3 and the remaining 1/3 was given to the immediate family.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">Later the family sold their 1/3 share of the estate to Sophia Debrah and her children. Sophia Debrah and Seven (7) of her children all died intestate, leaving behind Emmanuel Agyei Debrah as the last child to die and whose last Will is the subject matter of this suit. In his last Will Emmanuel Agyei Debrah devised and bequeathed to his wife and children the houses he built on the estate that was granted and acquired by his mother Sophia Debrah and his siblings who had all died intestate.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Anti
