A. Ofori Atta dated 5th June 2006. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Plaintiff/Appellant was employed by the Defendant/Respondent in 1990 and worked in Ghana from then until 1996. As at 1996, the Plaintiff/Appellant was the Executive Director of Finance and by the middle of that year, he was seconded to the Standard Chartered Bank, Tanzania until January 1999 when he was subsequently assigned to the Standard Chartered Group in Zimbabwe. He left Zimbabwe in 2001. The Plaintiff/Appellant returned from Zimbabwe only to realize that the Defendant/Respondent was not regularly paying her contribution to the Social Security Scheme for the benefit of the Plaintiff/Appellant during his retirement. The Plaintiff/Appellant dissatisfied with the turn of events caused a writ of summons to be issued against the defendant/respondent claiming the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">“1. A Declaration that the Defendant is in Breach of the Provisions of the Social Security Law 1991 PNDCL 247 and the Contract of Employment by failing to pay the Employer’s contribution due Plaintiff to the Social Security and National Insurance Trust. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">2. He contended that there was an understanding that although the Plaintiff/Appellant was posted outside Ghana, he would continue to enjoy all benefits due him. He further contended that he left the defendant/respondent’s employment in June 2001 and returned to Ghana only to discover that the Defendant/respondent his employer, had refused to pay the employer’s contribution of twelve and a half percent (121/2%) to the Social Security and National Insurance Trust (SSNIT) contrary to PNDCL 247 for the period scheduled on the endorsement of the Writ of Summons. He averred that the defendant/respondent’s refusal or neglect to pay his SSNIT contributions particularly after he moved from Tanzania to Zimbabwe was contrary to his contract of employment. He further averred that the defendant/respondent admitted in part to his claim in various correspondences between them. He pleaded that the Defendant/respondent’s conduct was not only wrongful but contrary to the Social Security Law PNDCL 247 but wilful and calculated to endanger his pension. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant/respondent entered appearance and filed a Statement of Defence in which he admitted that the Pla
