The plaintiff is making claim to this property because it is his case he had bought it from the grandmother of the defendant. The grandmother is Adjoa Sadzi,now deceased. There is no dispute the plaintiff sued Adjoa Sadzi earlier in a Circuit court in Suit No. CC590/88 and had judgment against her on 20<sup>th</sup> February, 1992. Plaintiff’s claim in that Circuit Court relevant for our purpose was for:<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">“(1) An order of specific performance against the defendant, compelling her to convey House Number E.101/11 lying and being at Nima, Accra as a result of a sale to plaintiff;<o:p></o:p></span></i></b></p><p class="MsoNoSpacing" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">(2) An order restraining the defendant, her successors, heirs, agents servants or workmen from interfering with plaintiff’s peaceful enjoyment of the said house;<o:p></o:p></span></i></b></p><p class="MsoNoSpacing" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">(3) An order of accounts for rents received by the defendant from 19<sup>th</sup> July, 1987, the day after the sale up to the day of judgment;<o:p></o:p></span></i></b></p><p class="MsoNoSpacing" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">(4) An order compelling the defendants to pay plaintiff all rents received by the Defendant from 15<sup>th</sup> July, 1988 to the day of judgment;<o:p></o:p></span></i></b></p><p class="MsoNoSpacing" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">(5) Interest at the current Bank rate of the total rents received by the defendant from 15<sup>th</sup> of July, 1987 up to the Day of Judgment”<o:p></o:p></span></i></b></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">He had judgment for these claims with little variation.
