Defendant/respondent company located in Takoradi is engaged in the production and sale of flour. In March 1998, the plaintiff contracted with the defendant for the supply of flour on credit basis. To secure payment for the flour supplied, the defendant demanded and plaintiff deposited with defendant title deeds on two properties.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">In October 1998, the plaintiff with a view to contracting for the supply of an increase quantity of flour or extra flour, deposited four documents with the defendant. Neither was any extra flour supplied to her on the basis of the said four documents. Rather, defendant in November 1998 terminated all business with plaintiff. Following the termination, the defendant sued to recover all debts owed by the plaintiff to defendant in Suit No. OS 1/99 under the Mortgages Decree, 1972 (NRCD 96) and then attached one of the first two properties whose title deeds was in her possession.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">Plaintiff then demanded the return of the title deeds on the four properties not covered by any transaction to enable her use them for other transactions with Ghana Agro Food Company (GAFCO) which she already had business dealing with. The defendant refused to return them.
