The Plaintiffs/Respondents exercised overt acts of ownership over the land in dispute by planting food crops and timber trees. The defendant claiming that the land belongs to the Ayiem Stool sent some persons on the land and destroyed the said trees of the plaintiffs/respondents and in their place, planted oil palm trees. The matter was reported to the Police and later the matter went to the Nsuaem Chief but when the defendant/appellant was invited, he refused to attend. Aggrieved by the behavior of the defendant/appellant, the plaintiffs/respondents caused a Writ of Summons to be issued against him claiming the following reliefs:-<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:Arial">“a. A declaration of title to that pieces or parcels of land lying and situate at a place near BOWOBRAYIE on Nsuaem Stool Lands and bounded by Albert Baido’s Farm, Opanyin Asaah Kwesi’s farm, Papa Yisa’s farm and Comfort Gyamera’s farm (formerly Kwesi Yenam’s farm).<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"> b. Recovery of possession of the said farm land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial"> c. An order to be directed at the Defendant to account to the plaintiff for the proceeds of sale of the plaintiff’s farm products which the Defendant unlawfully took possession from the plaintiff”.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">The Writ of Summons was accompanied by a Statement of Claim which was later amended. In their Amended Statement of Claim, the plaintiffs/respondents insisted that the land in dispute is under the Divisional Chief of Nsuaem and attached the map of the Stool Land as Exhibit “A”. They also averred that the defendant/appellant is the proposed Odikro of Ayiem and that he serves under the Divisional Chief of Nsuaem and therefore has no land of his own.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">On the other hand, the defendant/appellant denied the claim of the plaintiffs/respondents and averred that he is the substantive Odikro of Ayiem. He further averred that the land in dispute is at Bowobrayie and forms part of the Ayiem Stool Lands but did not form part of the Divisional Chief’s Stool Land. The defendant/appellant contended that the action is frivolous, vexatious and an abuse of process of the Court because Suit No. CI/22/06 entitled Mary Baah and 7 others vrs Nana Akye Kwasi III was pending at the Circuit Court, Tarkwa for the same reliefs.
