mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant (Arthur Richard) prayed the Commission to secure refund of underpayment of his per-diem allowance from the Respondent (Ministry of Energy) in respect of a course he undertook in Liquefied Petroleum Gas (L.P.G) in the Republic of South Korea in August 1997.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.4pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Respondent on the other hand failed to provide the necessary comments to the Commission in spite of several letters for comments coupled with invitation for discussion and the Complainant's consistency.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .55pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant alleged that the Ministry of Mines & Energy gave him and four others the opportunity to undertake further training in a course in Liquefied Petroleum Gas (L.P.G) in the Republic of South Korea in August 1997.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant alleged that upon their return to Ghana, the Ministry of Energy gave each of them an amount of ¢8,300,000.00 as their per diem through one of their colleagues, Clement Ayamga.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .7pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">He further alleged that they later got to know that the actual amount due each of them was rather ¢ 18,323,814 and not ¢ 8,300,000. He contended that they had this information when one of their colleagues, petitioned the Commission in a similar complaint, (Emmanuel Kofi Obimpeh vs. Ministry of Mines & Energy).<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .7pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant stressed that through the efforts of their colleagues, the Commission was able to get the necessary information to necessitate the payment of his per diem totaling ¢18,323.814.00.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant therefore petitioned the Commission to intervene by having the Ministry of Mines & Energy now Ministry of Energy refund his difference to him.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">FINDINGS AND OBSERVATIONS<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.65pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Upon receipt of the complaint, the Commission served copies of the complaint on the Respondent and requested its comments.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Respondent failed to honour the Commission's letters and reminders for comments. The Commission observes that the un-cooperative attitude of the Respondent has impeded the Commission's investigations and has compelled the Commission to decide the matter based on the evidence available.
