mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="margin-right:-.35pt;text-align:justify;text-indent: 4.5pt;line-height:115%"><span style="font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">On 14 January, 2009, the defendant filed <i>“a motion on notice to dismiss the suit for non-disclosure of cause of action under Order 11 rule 18 of C.I.47 and under the Court’s inherent jurisdiction”.</i> The main ground of the application is that the statement of claim did not only fail to disclose any reasonable cause of action, but is also an abuse of the process of the court. Two exhibits were attached to the affidavit viz: exhibit A is an agreement between the testator and his sub lessees - Andrew Balfour Antwi and Adelaide Kye and Exhibit B is a letter written by the 1<sup>st</sup>, 2<sup>nd</sup> and 3<sup>rd</sup> plaintiffs who are the executors of the testator’s will. Exhibit B, among others, authorized the defendant <i>to “take possession of the land and develop same forthwith”.</i> On 21 January, 2009, the plaintiffs also applied by motion for summary judgment.<o:p></o:p></span></p><p class="MsoNorm
