The defendants/respondents were served with the plaintiff's motion. On the date fixed for hearing of the motion, that is <b>03-03-09,</b> however, only the <b>1<sup>st</sup> defendant/ applicant </b>appeared in court and his response was that he was not opposed to the application but urged the court to impose such conditions as to ensure the plaintiff appears for trial before a court martial. At the time of the hearing of the application, there was no affidavit in the case docket from any of the defendants. The 2<sup>nd</sup> and 3<sup>rd</sup> defendants did not also appear in court. The court granted the plaintiff’s application by granting him bail on stated conditions.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">On <b>05-03-09,</b> the <b>2<sup>nd</sup> </b>and<b> 3<sup>rd</sup> defendants </b>filed a motion under <b>Order 42 of C.I. 47</b> for a review of the order of this court made on <b>03-03-09</b> and for a stay of execution of the said orders. This ruling is, therefore, in respect of the 2<sup>nd</sup> and 3<sup>rd</sup> defendants’ motion of <b>05-03-09</b>.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">I would begin by giving a brief fact of the case that generated these proceedings. The plaintiff, a captain in the Ghana Armed Forces, served as the <b>finance officer</b> for <b>MONUC GHANBATT 12 </b>in the <b>DR Congo</b> on a <b>UN Peacekeeping Mission</b> between <b>16<sup>th</sup> July, 2007</b> and <b>14<sup>th</sup> January, 2008</b>. He was given a financial instruction that covered the budget for the period of duty tour. In accordance with instructions, the plaintiff on arrival from the peacekeeping mission, prepared and submitted an account on the budget for auditing. The Audit Report made adverse findings against him. The Military High Command as a result ordered the plaintiff to be placed under close custody in accordance with service regulations. He was subsequently charged with <b>five offences</b> under the <b>Armed Forces Act, 1962 (Act 105)</b> and put before a court martial which is currently sitting. The plaintiff by his counsel applied for bail before the court martial which application was refused. He was released on bail by this court on <b>03-03-09</b> upon an application under <b>Article 14 (4)</b> of the Constitution. Thereafter, the 2<sup>nd</sup> and 3<sup>rd</sup> defendants brought the instant application for review. The purpose of the review is to revoke the bail that was granted.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The present application raises a procedural as well as a substantive issue.
