A declaration that the plotting of the judgment of the High Court, Accra in suit No. BL 272/2006 by 1st defendant to affect the interest of the plaintiff covered by Land Title Certificate No. TD 0153 is wrongful. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">b). An order directed at 1st defendant to amend the plotting of the judgment of the High Court Accra in suit No. BL 272/2006 to exclude plaintiff’s land covered by Land Title Certificate number TD 0153”. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Attached to the plaintiff’s writ of summons was a statement of claim.The defendants entered appearance and thereafter the 2nd defendant filed a defence which was later amended. Indeed, the 2nd defendant also filed a counter-claim in which he claims against the plaintiff for: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">“(1) Declaration of title to all that parcel of land vividly described by the Plaintiff in suit No. L. 84/99 which is situate, lying and being at Katamanso containing an approximate acreage of 3,865.45 acres and bounded on the North by Katamanso Stool land measuring 7,700 feet more or less, and bounded on the East by Katamanso Stool land measuring 8,300, 4,200, 700 feet, 5,000 feet [20,200] more or less, and on the South by Katamanso Stool land measuring 1,300 ft, 1,200 ft, 2,500 ft, 1,500 ft 1,550 ft, 1,600 ft, 500 ft, 1,800 ft [14,450 ft] more or less, on the West by Katamanso Stool land measuring 22, 400 ft more or less. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(2) General damages for trespass. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(3) Perpetual injunction restraining the Plaintiff, his servants, assigns, privies, workmen and all people claiming through the Plaintiff from entering and dealing in any manner, with the land the subject matter of 2nd Defendant’s counter-claim. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">(4) Recovery of possession of the small portion of the land that plaintiff forcibly encroached on”. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The plaintiff filed a Reply and a defence to counter claim and at the close of pleadings the issues set out in the application for directions as well as the issues in the further application for directions and the additional issues were all set down by the court for determination.
