After clearing the items at the Tema port they were transported to Mampong-Ashanti. At all material times, the plaintiff was assisted by one Issa on the instructions of defendant. Issa is a brother to the defendant.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The defendant later returned to Mampong and was presented with a bill of ¢18.7 million old cedis by the plaintiff being expenses allegedly incurred in clearing and transporting the goods to Mampong. The defendant refused to re-imburse the plaintiff with this amount. As a result, plaintiff instituted action in this court, then presided over by Mr. Justice A. K. Abada to claim the amount. Defendant counter-claimed for the recovery from the plaintiff the value of some of the goods he asserted could not be traced amongst the lot. The court entered judgment for the defendant on his counter-claim, whiles plaintiff was given judgment for only part of his relief. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">Thereafter, the plaintiff went to sleep. He woke up after fourteen and a half months when it was well passed the period allowed by the rules of procedure to file an appeal against the judgment. Nonetheless, he came back to this court differently constituted, and prayed for extension of time to appeal against the judgment aforementioned, alleging that it was obtained by fraud. On the basis of this allegation, Addo J, as he then was, issued an open ended order suspending the execution of the judgment, and further ordered the plaintiff to mount a fresh action in any court of competent jurisdiction to prove his assertion of fraud.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The defendant was aggrieved by the orders of Mr. Justice Addo, and therefore, appealed for redress. The Court of Appeal upheld plaintiff’s right to institute a fresh action to establish the allegation of fraud, but held as unjust, and therefore wrong, the open ended order suspending the execution of the judgment of Mr. Justice Abada in favour of defendant. The plaintiff prays for an order to set aside the judgment of Mr. Justice Abada of 26<sup>th</sup> June, 2002, entered against him because it was founded on fraud perpetrated by the defendant.
