</div>Awudu Mohammed hereinafter called “the
Petitioner” filed this petition against Cob - A Industry Limited hereinafter called "the Respondent” Claiming that
his employment was wrongfully terminated. <o:p></o:p><o:p>&nbsp;</o:p>The fact in support of the claim was that he
was employed as a Security Officer between June, 2007 and February, 2008 by the Respondent Company. <o:p></o:p><o:p>&nbsp;</o:p>The Petitioner contends that his termination
is unfair because he submitted excuse duties covering the periods in question
through a taxi driver who assured him of safe delivery and even made copies of
the said excuse duties for him therefore could not understand why the company
charged those number of days against him leading to his termination. <o:p></o:p><o:p>&nbsp;</o:p>The Respondent in response indicates that the
reason for the termination was 20 days vacation of
post which contradicts the company's Collective Agreement under Article
20.4.2.1. The Respondent further indicates that the Petitioner's salary was
once seized for similar offence and that the said excuse duty was produced after the termination letter was issued to the petitioner.
<o:p></o:p><o:p>&nbsp;</o:p>DECISION <o:p></o:p>The Commission finds that it is the habit of
the Petitioner to deliver expired excuse duty and through un-official means. <o:p></o:p><o:p>&nbsp;</o:p>The Commission
also finds that even though the Petitioner argued that he had submitted the excuse duty in question, he could not produce any documentary evidence of delivery. <o:p></o:p><o:p>&nbsp;</o:p>
