</div>FACTS: <o:p></o:p>Considering
the petition filed by
the Ex-workers of Map
Shipping Company Limited (hereinafter called the "Petitioners') against
Map Shipping Company Limited (hereinafter called "Respondent') on 23rd
August, 2007 and Respondent submissions dated 14th October, 2007; <o:p></o:p><o:p>&nbsp;</o:p>Considering
Sections 138 and 139 of the Labour Act 2003 (Act 651) on the functions and
powers of the Commission; <o:p></o:p><o:p>&nbsp;</o:p>Having
examined the written submissions of the Petitioners and the Respondent, the
facts of the case and pleadings may be summed up as follows: <o:p></o:p><o:p>&nbsp;</o:p>The
Petitioners submitted that the Respondent failed to pay their Social Security
and National Insurance Trust contributions
it deducted from their salaries from 2002 to 2007. <o:p></o:p><o:p>&nbsp;</o:p>The
Petitioners also submitted that they showed interest in joining Maritime and
Dockworkers Union of Trade Union Congress (TUC) on 5th February, 2007. They
contended that the Respondent threatened them with dismissal on 25th July, 2007
that they would be dismissed if they joined the union. However, the Respondent
could not dismiss them but rather, informed them that their clerical duties or
jobs had been sublet lo sub-contractor to avoid them being his employees. To
them, the management refused to accept the freedom of association under the
1992 National Constitution and the Labour Act, 2003 (Act 651).
