(hereinafter called the Respondent) on January 16, 2009 and the Respondent's submissions of March 13, 2009;<o:p></o:p><o:p>&nbsp;</o:p>Considering Sections 138 and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of the National Labour Commission;<o:p></o:p>&nbsp;<o:p></o:p>Having examined the written submissions of the Petitioner and the Respondent, and allowed the two parties to meet with the Commission;<o:p></o:p>&nbsp;<o:p></o:p>The facts of the case and pleadings may be summed up as follows:<o:p></o:p><o:p>&nbsp;</o:p>The Petitioner submits as follows that:<o:p></o:p>&nbsp;<o:p></o:p>A.&nbsp;&nbsp;&nbsp; She was an employee of the Respondent Company for eight (8) years and three (3) months.<o:p></o:p><o:p>&nbsp;</o:p>B.&nbsp;&nbsp;&nbsp;&nbsp; She was late to work one day and the director called her to his office to inform her that he could not work with her any longer.<o:p></o:p>&nbsp;<o:p></o:p>C.&nbsp;&nbsp;&nbsp; She was offered three (3) months salary in lieu of notice of her dismissal which she declined receipt.<o:p></o:p>
