The petition was received by the Commission on 14 February, 2006.<o:p></o:p>&nbsp;<o:p></o:p>The Commission wrote to the employer on 15 February, 2006 for their comments. The employer's response dated 13 March, 2006, was received by the Commission on 15 March, 2006.<o:p></o:p><o:p>&nbsp;</o:p>The Commission invited the parties to a meeting on 17 May, 2006. It was rescheduled for 24 May, 2006. The parties failed to attend the meetings. They were again invited for a hearing on 30 July, 2007. Both parties again failed to honour the invitation.<o:p></o:p>&nbsp;<o:p></o:p>Documents at the Commission on the issue were used to make a decision.<o:p></o:p><o:p>&nbsp;</o:p>The Complainant was a supervisor at the Melcom Super-Market at Adabraka. She was given an important notice to circulate among the workers to ensure that the content was complied with. It was that they should report for duty on 3 January, 2006, which should have normally been a rest day for them. Even though the Complainant received the notice and undertook to communicate same to the entire workforce, she failed to do so.<o:p></o:p><o:p>&nbsp;</o:p>The workers failed to report for duty. Employer considered this as wilful dereliction of duty and gross negligence with consequential financial loss and an unpardonable inconvenience to its esteem customers.<o:p></o:p><o:p>&nbsp;</o:p>The employer constituted a panel of disciplinary committee on 4 January, 2006. The panel of members comprised management staff, local union executives and ICU executives. The ICU ex
