Debrah (hereinafter called the Petitioner) against Ejura Farms Ghana Limited (hereinafter called the Respondent) on August 16, 2007 and the Respondent's submissions of January 31, 2009;<o:p></o:p><o:p>&nbsp;</o:p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Considering Sections 138 and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of the National Labour Commission;<o:p></o:p>&nbsp;<o:p></o:p>Having examined the written submissions of the Petitioner and the Respondent, and allowed the two parties to meet with the Commission;<o:p></o:p><o:p>&nbsp;</o:p>The facts of the case and pleadings may be summed up as follows:<o:p></o:p><o:p>&nbsp;</o:p>The Petitioner submitted as follows that:<o:p></o:p>&nbsp;<o:p></o:p>A.&nbsp;&nbsp;&nbsp; He was an employee of the Respondent Company until July 14, 2005 when he retired.<o:p></o:p>&nbsp;<o:p></o:p>B.&nbsp;&nbsp;&nbsp;&nbsp; He was denied his end of service benefits and a befitting send-off party.<o:p></o:p><o:p>&nbsp;</o:p>The Respondent also submits as follows that:<o:p></o:p><o:p>&nbsp;</o:p>C.&nbsp;&nbsp;&nbsp; The Petitioner was employed on February 1", 1979 worked for eleven (11) years and ten (10) months, and was retired on 31 December, 1990 as a senior staff.<o:p></o:p><o:p>&nbsp;</o:p>D.&nbsp;&nbsp;&nbsp;
