De-Kambe (hereinafter called the Petitioner) against CTC Cargo Tally Company Limited (hereinafter called the Respondent) on March 18. 2008 and the Respondent's submissions of April 29, 2008:<o:p></o:p>&nbsp;<o:p></o:p>Considering Sections 138 and 139 of the Labour Act, 2003 (Act 651) on the functions and powers of the National Labour Commission;<o:p></o:p><o:p>&nbsp;</o:p>Having examined the written submissions of the Petitioner and the Respondent, and allowed the two parties to meet with the Commission;<o:p></o:p><o:p>&nbsp;</o:p>The facts of the case and pleadings may be summed up as follows:<o:p></o:p>&nbsp;<o:p></o:p>The Petitioner submits as follows that:<o:p></o:p><o:p>&nbsp;</o:p>A.&nbsp; He was an employee of the Respondent Company from September 15, 2003 to August 1. 2006 when his appointment was terminated.<o:p></o:p><o:p>&nbsp;</o:p>B.&nbsp;&nbsp; He wants to be reinstated and compensated.<o:p></o:p>&nbsp;<o:p></o:p>C.&nbsp;&nbsp; He wants to be paid for overtime for seven days at weekends, from September 15, 2003 to October 15, 2003 and from September 15, 2003 to August 1, 2006, for weekdays.<o:p></o:p>
