In the said decision, the High Court entered judgment for the plaintiff for the reliefs endorsed on his Writ of Summons. There is varied narration as to the person who put up the building on this plot mentioned supra. Following the death of one of the successors of the late Opanin Damprane, plaintiff was appointed the head of family. At the gathering where plaintiff was appointed the head of family, the former in reciprocating the gesture, told the family gathering that, he was giving the uncompleted portion of the house in dispute to his children. The defendants and some other family members present left the gathering and went into consultation.
