The Court further held that: “The defendant has the right to occupy the self acquired property of his deceased father who died intestate in 1981. I award cost of ¢5M against the appellant”.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""> Dissatisfied with the decision of the court, the appellant with the leave of the High Court dated 23<sup>rd</sup> day of March 2007 filed the instant Appeal.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The Grounds of Appeal are as follows; <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(1) The Court erred in Law in considering certain facts in the last paragraph of his judgment for the determination of the main issue between the parties as found by the judge, i.e. whether children of a deceased person have a right to their father’s self acquired property under customary law.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(2) The Court erred in Law in not awarding title to the plaintiff as claimed when it found out that House No.ABR 108 IS A FAMILY PROPERTY BUILT BY LATE Akwasi Mensah who died intestate in 1981.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(3) The Court erred in Law in holding in his judgment that, breaking into the room and renovating doors and windows and other act and behaviour for example challenging Head of Family’s title by the defendant/respondent does not amount to “misconduct” that attract ejectment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(4) The Court erred in law in not ordering the Defendant/Respondent to account for the four (4) rooms he has rented to tenants without the consent of the Head of Family i.e. the Plaintiff/Appellant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(5) The Court erred in Law in upholding the decision that, Plaintiff/Appellant should pay ¢32,184,000 to the Defendant/Respondent, when the Defendant/Respondent had no authority to carry out the repairs.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(6) The Court erred in Law in relying on holding 4 of the judgment in the case of <b>In Re; Appiah (deceased) Yeboah Vs. Appiah 1976 1GLR, 223 H.C. when same has been over</b> ruled in the Court of Appeal’s judgment in the case of <b>Stephen Kwame Brobbey Vs. Yaa Konadu & others, Civil Appeal No. H1/145/2005 unreported.
