In its judgment, the court held among other things that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">“The evidence adduced by the 2<sup>nd</sup> defendant and her witnesses clearly demonstrates that she lawfully acquired the Store No. 18 from its rightful owner Mr. Fynn (1<sup>st</sup> defendant) and duly paid GH¢40,000.00 to Mr. Stephen Fynn which said transaction is evidenced by Exhibit 1. I accordingly enter judgment for the 2<sup>nd</sup> defendant on her counterclaim and hereby decree that ownership of Store No. 18 Rail way Quarters is duly vested in the 2<sup>nd</sup> defendant, Christiana Osei.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The plaintiff, her agents, assigns, servants and all those who may claim through the plaintiff are hereby perpetually restrained and or prohibited from in anyway disturbing, interfering and harassing the 2<sup>nd</sup> defendant in her peaceful enjoyment of Store No. 18 Railway Quarters, Kumasi.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">I award cost to the 2<sup>nd</sup> defendant against the plaintiff assessed at GH¢1,500.00”.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">Dissatisfied with the decision of the court, the plaintiff appealed to this court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The Grounds of Appeal are:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span style="font-family:"Book Antiqua","serif"">i The Honourable Trial Court erred when it failed to appreciate and recognize the fact that it is not the universal practice or custom in all marital homes that property that is acquired from the sweat and toil of both married couple be registered in both names.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span style="font-family:"Book Antiqua","serif"">ii The Honourable Trial Court erred when in the face of abundant evidence it based its findings on the point that the plaintiff did not adduce a scintilla of evidence to even show how much was paid in the acquisition of the Store No. 18 the subject matter of the suit.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span style="font-family:"Book Antiqua","serif"">iii The Honourable Trial Court erred when in the face of abundant evidence it wrongly assumed that unless and or until a marriage couple can show with mathematical accuracy or exactitude how much he/she contributed to the family income he/she cannot make a claim or have a share in the property acquired from their joint efforts and which efforts go beyond duties confined to their station of life.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span style="font-family:"Book Antiqua","serif"">iv The Honourable Court erred in law when it relied on extraneous matters using DW4’s evidence linking the sale of a Store at Railway Quarters sometime past by plaintiff to another person and saying that plaintiff was thus confronted by evidence staring her in the face by that reference.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span style="font-family:"Book Antiqua","serif"">v.
