Agreed cost of GH¢1,000 was awarded in favour of the Plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif"">Dissatisfied with the decision of the High Court, the Defendant filed the instant appeal. The Grounds of Appeal are as follows;<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:.3in;margin-bottom:0in; margin-left:.25in;margin-bottom:.0001pt;text-align:justify;text-indent:-.25in; line-height:115%"><b><span style="font-family:"Book Antiqua","serif"">[b] The judge erred when he held that, the Plaintiff vacated the four [4] store rooms, the subject matter of this dispute on 30<sup>th</sup> September 2005.<o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top:0in;margin-right:.3in;margin-bottom:0in; margin-left:.25in;margin-bottom:.0001pt;text-align:justify;text-indent:-.25in; line-height:115%"><b><span style="font-family:"Book Antiqua","serif"">[c] The judge fell in error when he held that the structural changes the Plaintiff made to the premises were done with the knowledge, consent and approval of the Defendant.<o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top:0in;margin-right:.3in;margin-bottom:0in; margin-left:.25in;margin-bottom:.0001pt;text-align:justify;text-indent:-.25in; line-height:115%"><b><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></b></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;text-indent: .25in;line-height:115%"><span style="font-family:"Book Antiqua","serif"">On the 17-2-09, counsel for the Defendant/Appellant filed Additional Ground of Appeal to wit;<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif"">“The judge fell in error when he held that, it was the store rooms, subject matter of litigation that the Defendant/Appellant opened for PW3 and Orga Willie to inspect.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;text-indent: .5in;line-height:115%"><span style="font-family:"Book Antiqua","serif"">Before going into the merits or otherwise of this Appeal, I will like to give a brief background of this case.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;text-indent: .5in;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The Plaintiff/Respondent in this case issued out a writ of summons claiming from the defendant/appellant the following Reliefs;<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif"">[1] Refund of ¢293,474,000 being the outstanding balance of the rent advance paid to the Defendant at his request and interest on the said sum at the current bank rate from 1-5-2002 till date of final payment.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif"">[2] Refund of ¢15,735,000 being express born by the Plaintiff on the instruction of the Defendant in order to render the four[4] store rooms rented fit to be used as shops and interest thereon at the current bank rate from 1-7-05 to date of final payment.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif"">[3] Damages for breach of contact.<o:p></o:p></span></p><p class="MsoNormal" style="margin-right:.3in;text-align:justify;line-height: 115%"><span style="font-family:"Book Antiqua","serif""> The Plaintiff/Respondent’s case as can be deduced from the pleadings and evidence on record is that, somewhere in the year 2003, he agreed with the Defendant/Appellant, who was then putting up a building consisting of store rooms at Roman Hill, Kumasi, to rent four of the rooms which the Plaintiff/Respondent was to use to ran a cold store. In line with the agreement, the Plaintiff paid various sums of money totaling ¢301m [GH¢30,000] to be Defendant and extra ¢1,000,000 [100] to connect electricity to the store rooms. It is the case of the Plaintiff/Respondent that, on completion of the building, contrary to the agree
