In this appeal the plaintiff will be referred to as the Appellant and the Defendants would be referred to as the Respondents. By the Notice of Appeal filed on the 28-4-09, the Appellant appealed against the judgment dated the 22-12-08 and the ruling delivered by the trial court dismissing Appellant’s application for review.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">Before I proceed further, I need to comment on the procedure adopted by Counsel for Appellant in initiating this appeal. The trial court delivered a final judgment in Suit No. AHR52/2007 on the 22/12/2008. Under the Court of Appeal Rules, CI 19 as amended appeals against final judgments are regulated by specific rules. For example by Rule 9(1) (b) the time limit for appealing against a final decision, like the judgment of 22-12-08, is three months unless extended by the court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">Beside the final judgment of 22-12-08, the Appellant applied for a Review of the trial court’s decision and a ruling was delivered on the 19-3-2009. That ruling being interlocutory, the Appellant had twenty-one days within which to file an appeal, which time could not be extended.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Tahoma">In view of the varying conditions under the Rules for appeals against final and interlocutory decisions, it was wrong for Counsel for Appellant to have combined the two appeals and prosecuted same by one Notice of Appeal.<b><o:p></o:p></b></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;tab-stops:4.5pt"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">From the Notice of Appeal filed on the 28-4-09, it is evident that the Appellant was out of time as far as the interlocutory appeal was concerned. The ruling dismissing the application for review was delivered on 19-3-09 and the appeal was filed on 28-4-09, clearly outside the twenty one days stipulated by the Rules. The entire Notice of Appeal as filed to my mind is flawed. However I will save the appeal against the final judgment and strike out the appeal against the ruling of 19-3-09. That appeal is accordingly struck out. In the circumstance ground (b) of the Notice of Appeal which relates to the application for review would also be struck out.
