After entering appearance to the amended writ of summons, the 3<sup>rd</sup> and 4<sup>th</sup> defendants filed a motion on notice praying for an order of the court to <i>“set aside the writ of summons on the grounds of want of capacity and for any further order or orders as the court deems fit”</i>.
