A declaration of title to all that piece or parcel of land lying and situate at Adamorobe and described in the schedule to the endorsement below (including Seduase lands).<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">2. An order declaring that the statutory declaration made by the defendant claiming ownership of Seduase is null and void.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">3. Damages for trespass.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">SCHEDULE<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">ALL THAT PIECE AND PARCEL OF LAND being, lying and situate at Adamorobe, the boundary whereof commencing of North Eastern Centre culvert of the Aburi-Adamorobe Motor road and is 800 feet and at bearing of 73’ 30’ which bearing together with all further bearings mentioned is referred to Meridian 1’ West Longtitude to a Peg marked “A” and thence on a bearing stated for 3060.00 feet to Peg 6 which marked the end of Ahwerease Asakyiri Property and thence on a bearing for 2600 feet to Peg 14 which marks the end of Asona Family Property and thence on bearing stated for 1020.00 feet Peg 16 which marks the beginning of Obosumase Stool land and thence on bearing stated for 12,848.00 feet to Peg 32 which marks the end of the said Obosumase Stool lands and thence follows the said Accra-Dodowa Motor road in the South direction to Oyibi for 10,600 feet to Adamorobe-Oyiri Junction and thence follows the Dodowa-Adamorobe road in the North Western direction for 800 feet to a pillar marked 33 and thence on a bearing of 273’00 for 130.00 feet to Peg 34 and thence on bearing 299’30’ for 720.00 feet to Peg 35 and thence on a bearing 37’ 15’ for 700.0 feet to a culvert on the said Adamorobe - Aburi Motor road and thence follows the aforesaid Adamorobe - Aburi Motor road for 4250.0 feet to the point of commencement thus enclosing an area of 9200.36 feet acres approximately more or less.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">I need to put it on record that at the later stages of the trial it was reported to the court that the original Plaintiff, Deesah Penrose was dead. In the result the court granted a substitution order, substituting Abusuapanyin Kwesi Doudu for the deceased. The substitution necessitated amending the writ to reflect the change in the title of the case. Pursuant to that order of substitution made on 20/05/10 the Amended Writ of Summons was filed on 20/08/10. The reliefs as endorsed on the amended writ, however, remained the same as the earlier writ filed pursuant to the order of the court made on 19/11/2001.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The thrust of the case of the Plaintiff is that the land, the description of which is given supra, belongs to the Kwaakwa Asampong Asakyiri family of Aburi-Adamorobe and that his predecessors granted the defendant’s predecessors licence to occupy part. Not only that. They were also given farming rights to till the land but on condition that they paid yearly tolls in the nature of fowls, eggs, yams, natural water etc to the chief during the celebration of the Plaintiff’s Osedu Shrine Festival. The land was not for sale, according to the Plaintiff. However, the defendant’s people stopped paying the tolls after practicing it for some time but started asserting that they were the owners of the land. That triggered off this instant action. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is worth mentioning that the defendant denied substantially the claims of the Plaintiff and averred in his Statement of Defence that his predecessors purchased the land from the Plaintiff’s predecessors and that his land comprises of aggregate of various purchasers which sale is buttressed by the evidence of Nana Osae Amantem contained in the Jackson Commission Report. The defendant, however, did not counterclaim against the Plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">ISSUES:<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The defence raised the following Issues (as contained in the Summons for Directions filed on 22/08/2001) for determination by the court:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">1.
