In or about 1991, she received information from the Defendant that there was a parcel of land at Abossey-Okai (Korle Lagoon Area) so she should send money for the purchase of the said land. Based on the said information, she immediately sent US$5,000.00 to the Defendant through one Kwasi Clay. Subsequent to this, she sent down various sums of money to the Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial">Later, the Defendant called her and asked that she should send US$3,000.00 to be used in fencing the said land to ward off intruders which she duly sent.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial">In 1991, the Plaintiff came down to Ghana and the Defendant showed her the land in question. However, the document on the land bore the names of S. K. Adu, the Defendant herein and J. A. Mensah, Defendant’s brother, now deceased. She questioned the Defendant why her name was not on the document, but he could give no tangible reason but promised to effect the necessary changes in the names to reflect her name. The Defendant has, however, refused to change the names into her name to properly vest ownership of the land in her.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-fareast-font-family:Arial; mso-bidi-font-family:Arial">In or about June 2006, when the Plaintiff came down once again to Ghana, she was informed that J. A. Mensah had died and that a brother of his was now claiming ownership of the said land.
