The Respondent/Applicant sat on the case and ruled against the Appellant/Respondent on 3<sup>rd</sup> October, 2008. The Appellant/Respondent being dissatisfied filed Notice of Appeal dated 15<sup>th</sup> October, 2008 against the decision of the Respondent/Applicant at the High Court, Accra.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The Respondent/Applicant goes on to aver that after settlement of records, the Appellant/Respondent was served with the conditions of appeal on 19<sup>th</sup> June, 2009. On 10<sup>th</sup> December, 2009 the Respondent/Applicant conducted a search at the Registry of the High Court which ascertained that the Appellant/Respondent had failed to fulfill the conditions of appeal as mandated by the rules of this Court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The Respondent/Applicant contends that the Appellant/Respondent’s Notice of Appeal filed on 15<sup>th</sup> October, 2008 has lapsed and since the time to apply for extension of time has also lapsed, the Notice of Appeal is incompetent and same must be struck out.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The Appellant/Respondent has opposed the application on three main grounds. The first one being that it is a breach of the rules of natural justice for the Chairman of the Respondent/Applicant’s panel that adjudicated the matter between the Appellant/Respondent and the said Joseph Okine to transform into counsel for the Respondent/Applicant which is acting for the interested party. The behaviour of the said counsel is also against the professional etiquette rules for counsel for the Respondent/Applicant, having ceased to be the Deputy Chairman of the Respondent/Applicant to act in his personal capacity as counsel for it in defence of a decision taken by him.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The second ground for opposing the application is that the result of the search conducted by the Respondent/Applicant is incorrect since Appellant/Respondent had satisfied the conditions of appeal at the time of the search.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The third ground was that the delay in satisfying the conditions of appeal resulted from administrative lapses. According to the Appellant/Respondent, considering the fact that the record of appeal comprised of only a ruling from the decision of the Respondent/Appellant and interlocutory proceedings from the High Court, the amount of GH¢1,300.00 which the Appellant/Respondent was asked to pay as deposit and cost of photocopies was too high, so it raised objection as a result of which it was later reviewed by the Registrar.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","s
