Subsequently, they filed Motion on Notice for Stay of Execution pending Appeal on 13<sup>th</sup> November, 2009.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The Plaintiff/Respondent opposed the application in an Affidavit in Opposition filed on 30th November, 2009.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">On 4<sup>th</sup> February, 2010 when the motion came on for hearing, counsel for the Plaintiff raised a preliminary legal objection on two main grounds. His first ground being that the Affidavit in Support had not been sworn to, so the document was a mere paper which could not qualify as an Affidavit. It was, therefore, in conflict with Order 20 R 2 of CI 47.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">His second ground being that the Defendants/Applicants had addendums to their Affidavit which they have identified as Exhibits AG1 and AG2. However, they have not filed certificate of Exhibits as required by Order 20 R 14 (1) (2) and (3) of CI 47. He goes on to argue that the requirement is mandatory and Order 81 of CI 47 cannot cure the defect.<o:p></o:p></span></p><p cl
