The Court held as follows:-<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">“From the above therefore I am satisfied that the Plaintiff has proved his case and is entitled to judgment.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">Accordingly I enter judgment for Plaintiff for declaration of title to the plot in dispute albeit in the name of his son, Abubakari Madi. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">The Plaintiff is also awarded cost of ¢2million”. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">Dissatisfied with the decision of the District Court, the 2<sup>nd</sup> Defendant appealed to the High Court, Kumasi. On the 9-7-09, the High Court, Kumasi upheld the appeal except the Additional Ground (a) and entered judgment for the 2<sup>nd</sup> Defendant/Appellant in respect of his counterclaim. The Court awarded cost of GH¢1,500 for the 2<sup>nd</sup> Defendant/Appellant against the Plaintiff/Respondent.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">Aggrieved with the judgment of the High Court, the Plaintiff/Respondent appealed to this Court. The Grounds of Appeal are:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(a) The High Court Judge erred in law when he considered the additional grounds of appeal filed by the 2<sup>nd</sup> Defendant/Appellant/Respondent when leave was not sought before same were filed.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(b) The Judge failed to give adequate consideration of the case of the Plaintiff/Respondent/Appellant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(c) Further grounds of Appeal will be filed on receipt of the record of proceedings. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The relief sought from this Court is: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">“The Judgment of the High Court be set aside and the Judgment of the District Court be maintained”. <o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">Before dealing with the merits of this appeal I will give a brief background of this case.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">The plot in dispute, plot No. 15 Block G Brofoyedru, Kenyasi in the Kwabre District of Ashanti belonged to one Osumanu Musah who died intestate on the 16-7-02. This Osumanu Musah was survived by his wife Hajia Aryee and a daughter Zubaida. The brother of the deceased, the 2<sup>nd</sup> defendant, was jointly granted Letters of Administration with the daughter of the deceased Zubaida. 1<sup>st</sup> Defendant sold the plot in dispute to the Plaintiff and the 2<sup>nd</sup> Defendant resisted Plaintiff’s occupation of the disputed land. The Plaintiff therefore sued 1<sup>st</sup> and 2<sup>nd</sup> Defendants jointly and severally for declaration of title to the building plot No. 15 Block G situate and lying at Kenyasi in the Kwabre District which 1<sup>st</sup> Defendant sold to the Plaintiff and 2<sup>nd</sup> Defendant lying adverse claim to it. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">IN THE ALTERNATIVE <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(1) ¢20,000,000 being the cost of the said building plot <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">(2) ¢3,000,000 being cost the Plaintiff incurred in the preparation of documents covering the said building plot.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">As stated supra the District Court gave judgment for the Plaintiff on his claim. The 2<sup>nd</sup> Defendant aggrieved by the decision of the District Court appealed to the High Court which reversed the decision of the District Court. Aggrieved with the decision of the High Court the Plaintiff appealed to this Court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">In this appeal, the Plaintiff/Respondent/Appellant would be referred to as appellant and the 2<sup>nd</sup> Defendant/Appellant/Respondent would be referred to as the respondent. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">In his written submissions filed on the 9-4-2010, counsel for the Appellant abandoned the 1<sup>st</sup> Ground of Appeal and dealt with only the 2<sup>nd</sup> Ground of Appeal. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">2<sup>nd</sup> Ground of Appeal.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua","serif"">“The judge failed to give adequate consideration to the case of the Plaintiff/Respondent/Appellant”.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua","serif"">In arguing this Ground of Appeal, counsel for the Appellant submitted that, the grant of Letters of Administration to the respondent does not vest ownership
